These Terms of Service govern access to and use of Service Bay OS, including our website, software, onboarding and related services. By creating an account, starting a trial or using the service, the customer agrees to these terms.
1. The service
Service Bay OS provides software and workflow tools intended to support automotive repair businesses, including customer and vehicle records, estimates, work orders, communications, automations and related operational features. Features may change as the service develops.
2. Accounts and authorized users
Customers are responsible for providing accurate account information, protecting login credentials, managing authorized users and all activity under their account. Access must not be shared with unauthorized persons.
3. Customer responsibilities
Customers are responsible for their business operations, customer relationships, service recommendations, pricing, estimates, repairs, legal notices, consent obligations and the accuracy of information entered into the platform. Service Bay OS does not perform vehicle diagnosis or repair.
4. Acceptable use
Customers must not use the service to violate law, infringe rights, send unlawful or deceptive communications, introduce malicious code, attempt unauthorized access, interfere with the service, reverse engineer protected components or use the platform for activities outside its intended business purpose.
5. Customer data
Customers retain their rights in information they submit to the service. Customers grant Service Bay OS permission to host, process, transmit and display that information as needed to provide, secure, support and improve the service. Customers represent that they have the necessary rights and permissions for the data they submit.
6. Trial, fees and billing
The intended standard offer is a 30-day free trial followed by a recurring fee of CAD $297 per month. The final price, trial terms, taxes, renewal date and payment details shown at checkout control. The customer authorizes recurring charges after the trial unless the subscription is cancelled in accordance with the stated cancellation process.
7. Cancellation
Customers may cancel future renewal through the cancellation method provided by Service Bay OS. Unless required otherwise by law or expressly stated at checkout, charges already incurred are non-refundable and access may continue until the end of the paid billing period.
8. Third-party services
The service may rely on or connect with third-party providers, including payment, communication, social, review and hosting services. Third-party services are governed by their own terms, availability and policies, and Service Bay OS is not responsible for changes or interruptions controlled by those providers.
9. Intellectual property
Service Bay OS and its licensors retain all rights in the platform, software, branding, templates, documentation and related materials, excluding customer data. No rights are granted except the limited right to use the service during an active subscription.
10. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. We may maintain, modify, suspend or discontinue features when reasonably necessary, including for security, legal or operational reasons.
11. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” Service Bay OS disclaims implied warranties, including merchantability, fitness for a particular purpose and non-infringement. The platform does not replace professional automotive, legal, tax or accounting advice.
12. Limitation of liability
To the maximum extent permitted by law, Service Bay OS will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost revenue, business interruption or loss of data. Any aggregate liability will be limited to the amount paid for the service during the three months preceding the event giving rise to the claim.
13. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security risk, unlawful use or conduct that threatens the service or others. Provisions that by their nature should survive will remain in effect after termination.
14. Governing law
Unless applicable law requires otherwise, these terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
15. Changes to these terms
We may update these terms from time to time. Material changes will be communicated where required, and continued use after an effective date constitutes acceptance of the updated terms.
